LaunchSwift — Terms of Service

These Terms of Service ("Terms") govern your purchase and use of LaunchSwift ("the Product"), created and maintained by Ricardo Cardona Trejos ("we", "us", "our").

By purchasing or using LaunchSwift, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Product.

1. Product Description

LaunchSwift is a commercial iOS app boilerplate built with SwiftUI. It provides source code, templates, and tooling to accelerate iOS app development. The Product is sold as a source code license, not a SaaS subscription.

2. License Grant

Upon a valid purchase, we grant you a perpetual, non-exclusive, non-transferable license to:

  • Use the Product to build unlimited applications (personal, client, or commercial)
  • Modify the source code for your own projects
  • Access the private GitHub repository containing the Product

Pro License ($149): Grants access to a single individual developer.

Team License ($299): Grants access to up to five (5) developers within the same organization or team.

3. Updates

Your purchase includes one (1) year of updates from the date of purchase. During this period, you will receive:

  • Access to all new features, modules, and improvements pushed to the repository
  • Bug fixes and security patches

After the update period expires, you retain full rights to use the version you have. You may purchase a renewal to continue receiving updates.

4. Restrictions

You may NOT:

  • Redistribute, resell, sublicense, or share the Product's source code (or substantial portions of it) as a boilerplate, template, starter kit, or competing product
  • Share your repository access credentials or invite unauthorized users
  • Claim authorship of the original Product
  • Use the Product in any way that violates applicable laws

5. Ownership

We retain all intellectual property rights in the Product. Your license grants usage rights only — it does not transfer ownership of the code, design, or documentation.

Code you write on top of LaunchSwift belongs to you. The underlying boilerplate remains ours.

6. Purchases and Payment

All purchases are processed through Polar.sh. By purchasing, you also agree to Polar.sh's terms of service and payment processing terms.

Prices are listed in USD and are subject to change. Price changes do not affect existing purchases.

7. Refunds

We offer a 30-day money-back guarantee.

Upon refund, your license is revoked and repository access is removed.

8. Access Revocation

We reserve the right to revoke repository access if you:

  • Violate these Terms (especially the redistribution restriction)
  • Receive a refund
  • Engage in abusive behavior toward our team or community

9. Disclaimer of Warranties

The Product is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

  • The Product will be error-free or uninterrupted
  • The Product will meet your specific requirements
  • The Product will be compatible with all development environments

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Product shall not exceed the amount you paid for the Product.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

11. Third-Party Services

The Product integrates with third-party services (Apple, Cloudflare, TelemetryDeck, etc.). We are not responsible for the availability, terms, or conduct of these services. Your use of third-party services is governed by their respective terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the repository or email. Continued use of the Product after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Licensor resides, without regard to conflict of law principles.
